Collection Agencies
The State
Board of Collection Agencies (SBCA) regulates collection agency
activities in Arkansas. Collection agencies must licensed if (1)
they are located in Arkansas or (2) if they contact consumers
in Arkansas. The SBCA works to protect creditors who give their
accounts to collection agencies to be collected and consumers
who are being contacted by collection agencies. It is our goal
to reduce undesirable collection activity, to ensure compliance
with the Fair Debt Collection Practices Act and to educate Arkansas
consumers as to their rights when dealing with a collection agency.
The SBCA investigates
consumer complaints of unfair or unconscionable collection practices,
assessment of prohibited collection charges, and un-licensed activity.
Check-Cashers
The SBCA
also regulates the activity of check-cashing companies. We investigate
allegations of overcharging, early depositing of checks, criminal
prosecution of insufficient checks, etc. We audit check-cashing
companies on a regular basis to ensure compliance with state law.
The SBCA is
committed to licensing and regulating collection agencies and
check-cashers in the most expeditious and fair manner possible
and to safeguarding the rights of the citizens of Arkansas.
